Article on Credit Reports from the Toronto Star by Ellen Roseman

Published On Sun Sep 5 2010

Published in the Toronto Star-September 5, 2010

By Ellen Roseman Personal Finance Columnist

Your credit score is a three-digit number that can determine whether or not you get a loan and at what rate.
Many insurance companies also use credit scores to decide what you pay to protect your home and belongings from damage.
So, what does your credit score say about you? How can you get it? And how can you improve it?
Credit scoring was developed by Fair Isaac & Co. in the United States to help credit bureaus assess the risk to lenders.
Equifax, one of Canada’s two major credit bureaus, is licensed to use the FICO score, known as the Beacon score here. Its rival, TransUnion, uses a slightly different score (called Empirica).
Your credit score is not the same as your credit report, which shows your payment history. The credit report is free for you to check, but you can’t get your credit score without paying $15 to $25 or so to check it online.
Ignore any offers of free credit scores. They’re only teasers to sell you something else, such as a monthly credit monitoring service.
Eric Putnam spent 26 years in consumer lending before starting a company, Debt Coach Canada. He charges a monthly fee to people who want help organizing their finances and improving their credit scores.
I asked him what goes into a credit score – a secret guarded carefully by the credit bureaus.
The biggest part of the score (35 per cent) is your payment history, he says. This shows if you pay bills on time, have any unpaid debts or have been through bankruptcies, consumer proposals or debt management plans.
Another big part (30 per cent) is based on how much you owe.
If you carry an $8,000 balance on a credit card with a $10,000 limit – even if you pay the minimum on time each month – your credit score will drop. So, it pays to keep your balances down and not get close to your credit limits.
Another 15 per cent of your credit score is based on how long your accounts have been open and used. You may be a newcomer to Canada with no record of loans or someone whose spouse takes care of all credit transactions.
To be seen as a good credit risk, it’s not enough to be approved for credit. You have to use the credit you’re given.
Another 10 per cent of your credit score depends on the balance between revolving credit (such as credit cards) and instalment loans (such as mortgages or car loans).
Lenders like to see both types of credit. Revolving credit can be maxed out since the rates are high enough to absorb losses, while instalment loans with fixed payments must be approved and supervised closely.
The remaining 10 per cent of your score is based on how much new credit you’ve obtained or applied for. This shouldn’t be too high a percentage of all the credit shown on your file.
If you’re shopping for credit, do it within a 15-day period, Putnam says, since that will show as one credit inquiry.
Otherwise, do your shopping with a copy of your credit score, which you can show to lenders to find out what they will offer you.
Banks may give the three-digit number if you ask, but they’re not supposed to give the context that goes with it.

Natale Law Offices

Natale law Offices assists various creditors in recovering funds outstanding. One of the methods which Deanna Natale relies on is the mailing of letters with a draft statement of claim enclosed. The enclosure clearly states that it is a draft and at this stage a file has not been reviewed for litigation. The purpose of the staff at Natale Law Offices is to receive calls and attempt to contact consumers with outstanding debts.

When a call is received the staff are expected to be professional and polite at all times. furthermore, to help identify the account they request that the caller provide a file reference number. This number is located on the letter sent to the consumer and not on the draft claim attached. It is on the top left hand corner of the letter and is referenced as the File No.

Also staff are required to identify or verify the identity of the caller to ensure they are dealing with the party who owes the money and do not divulge personal or confidential information. If you have been asked to respond on behalf of someone else regarding a letter received the individual named in the letter must provide a written authorization. The authorization must state the name of the consumer, reference the file number and be signed by the original debtor. it can the be faxed to 1-866-207-9149.

Natale Law Offices

It has been a very busy week at Natale Law Offices. It is a pleasure to assist people with advice and information which in turn assist our clients. The staff at my office are well trained and professional and it is not unusual for me to get a call complementing how my staff handled a file. Specifically I have received compliments regarding Andrea, Matt and Sam. These staff members have been with my team for over four years and their professionalism and assistance is greatly appreciated.

Natale law offices-Small Claims Court

The limit for the Small Claims Court in Ontario has increased to $25,000 effective January 1st, 2010. This increase in the limit recognizes the costs and time commitment of litigation and enhances access for self represented individuals or others to the justice system. It recognizes the need within this dollar range to have access to justice while not being required to incur significant legal costs.

Natale law Offices has a significant amount of experience representing creditors in Small Claims Court. Natale law Offices believes the system works efficiently and effectively to ensure its clients obtain judgment and have access to all enforcement remedies.
A judgment once obtained may be enforced through a variety of methods. The most successful is garnishment of employment income. This allows for steady payments of the outstanding judgment. Another successful tool regularly relied on by Natale law offices is the garnishment of bank accounts. If a bank account is located and garnished the entire amount in the bank account is typically subject to seizure and application against the judgment

Recently, I received several telephone calls relating to correspondence forwarded to a previous address for a consumer who owes money. It is very much appreciated when we receive a call letting us know that our client has an old or outdated address or telephone number. Once we are advised of this information our records are updated and our client is advised. My Assistants will be professional and polite and appreciate being told if they are attempting to reach someone at a wrong number or address. It is not only a waste of our resources, it may be an aggravation for the individual who now resides at the previous address of a consumer who was delinquent in the repayment to their creditors or obtains the same telephone number.

Natale Law offices-Credit bureau information

The two major credit bureaus in Canada are Equifax and Trans Union Canada.

They collect personal credit information and sell it to banks, department stores, employers and others, and you have the right to know what information they have on you. Usually, both agencies have similar information, so if you want to check your credit rating and history, you probably only need to check the records of just one of them. The toll-free phone number for Equifax is 1.800.465.7166 and its website is www.equifax.ca. Trans Union Canada’s toll-free phone number is 1.866.525.0262 and its website is www.transunion.ca.

Demand Letters and debts

If one receives a legal demand letter it is important that they respond. It is surprising how easy it is to speak with a qualified representative and work out a resolution to an outstanding debt. Owing funds or money can be very stressful and the sooner an individual deals with the situation the better they feel.

Natale Law Offices

I just received a call from an individual. Our office had dialed a wrong number, the individual was upset because she had received several calls. I confirmed we had the wrong number and the number was removed from the file.

If you have received a call and you are not the person who owes the money to my client please contact us as soon as possible. For contact information please go to www.natalelawoffices.com .

Responding to a Claim

In Ontario, a creditor can serve a claim in the Small Claims Court by mail and this provides the defendant, (the individual being sued) with time to file a defence. If you have received a claim from Natale Law Offices there will be no reference to "Draft", the document mailed will have a court file number and will have been signed by a clerk. This is a very important legal document which should be responded to. If received, it is appropriate to contact Natale Law Offices immediately if you believe you have a defence, or, if you are willing to make arrangements to repay the debt in order to avoid the creditor from obtaining a judgment against you.

Natale Law Offices-Demand Letters

If an individual who owes money to a creditor in Canada receives a demand letter from Natale Law Offices referencing an attachment which is a draft and which has no court file number and no clerk signature the attachment has not yet been issued by the court.

It is appropriate to contact Natale Law Offices and an assistant at Ms. Natale's office will be pleased to listen to you with respect and professionalism Please call 1-866-279-7542 or the number listed on the letter and have your file number available.

If after contacting Natale Law Office you feel you have been treated poorly or have a concern regarding how your file is being handled please contact Ms. Natale directly at 905-413-8748.

Draft Statement of Claim-Natale Law Offices

I received a call from a consumer/debtor who owed money to our client and had received a demand letter with a statement of claim attached. She was concerned and explained that she could not repay the monies owed because she had suffered a workplace injury and was unable to work and had no income. She expected to receive income replacement from WSIB and would at that time make efforts to call to see if she could address her delinquent account. She thanked me for listening and promised to contact my office once matters were resolved for her.

Provincial regulations

Civil files for the recovery of funds proceed through the provincial court systems. Accordingly, each province has its own rules and requirements for the issuance of a claim and the enforcement of a judgment. Currently, in Ontario all outstanding or delinquent accounts with a principal outstanding balance of $25,000 or less should be pursued in the small claims court. This is beneficial for several reasons, two of which are cost and efficiency.

Natale Law Office Draft Statement of Claim

It is very effective to send a draft statement of claim for our clients who are creditors. The letters are sent to people who owe money and those people respond to the letter in an increased percentage when it is sent from Natale Law Offices. Since the staff at Natale Law Offices are trained professionals who are polite and well trained consumers/debtors who call in to deal with their delinquent accounts tend to have a positive experience. If the wrong person has been contacted, information on the file is updated and forwarded to the client. Otherwise the staff at Natale Law Offices, under the direct supervision of Deanna Natale, and the consumer/debtor talk through possible solutions to assist them in repaying the funds that are outstanding. Often if funds are available clients of Natale Law Offices are willing to work with the consumer to avoid having a file proceed to litigation. Litigation is in fact a last resort for Natale staff and its clients, and this is obviously also beneficial to the consumer/debtor. There is nothing fraudulent about the letters, the demands are made for monies that are outstanding to legitimate clients. Occasionally the wrong party is contacted because they have a similar name, or previous address or previous phone number but more often than not, the proper party is reached and the file/activity proceeds. The best course of action for anyone who has received a letter is for them to call back as soon as possible and deal with the letter/demand.

If anyone has received a call and has any questions or concerns they can call Deanna Natale personally at 905-413-8748 and she will be happy to help. She is very pleasant to speak with. Also they can speak to a manager who will also be professional and courteous if she is not available and they have some concerns or a possible complaint.
Once a delinquent account file is referred to Natale Law Offices typically a demand letter will be sent to the last known address of the debtor. The demand letter will identify the creditor-the party to whom the funds are owing, the amount owing and a file reference number. If the balance owing is high enough the letter may include an attachment which is a draft statement of claim. An issued statement of claim has a court file number on it. The demand letter with the draft statement of claim is not an issued claim and the letter is clear about that. The letter is a legitimate demand for funds owing from a party. The clients, who authorize the letters, are pursuing money they legitimately believe is outstanding and there exists no support for anyone who alleges they are fraudulent or a fraud. The letter clearly and unequivocally states that the attachment is a DRAFT only. The attachment clearly states it is a draft. For anyone to interpret it differently is without foundation or support. There is nothing fraudulent whatsoever about the letters which Deanna Natale authorizes to be sent from her office, Natale Law Offices. If a consumer has a question or a concern they should call her directly at 905-413-8748.

Natale Law Offices-Deanna L. Natale

The law office specializes in recovery of outstanding debts for clients. Typically these debts have been assigned to a collection agency which has been unable to recover the funds owing to its clients. The file is then referred to Natale Law Offices.

I received a call from a consumer who had received a demand letter with draft claim attached. She knew that she owed the money but had just recently returned to work and had a number of bills outstanding. She required some time to repay the account if possible. I spoke with my client and was able to negotiate acceptable terms of repayment for her and for the client/creditor. She was relieved and expressed her gratitude for our help.

Deanna Natale - Natale Law Offices

Today I received a call from a consumer who had settled her account in full at our office a year ago but her credit bureau had not been updated. She had misplaced the settlement letter provided. We were able to immediately provide her with written confirmation of the settlement and the client was advised of the required update to her bureau.
I received a call this morning from a consumer querying why his bureau has not been updated to show he paid off his account. My advise to the caller was for him to send the Letter of Release he received from our office to the credit bureaus and have them update his record. The Letter of Release is an important and offical piece of document which shows that you have been released from a debt. The moment that document is handed to you it should be presented to the bureaus to have your credit profile updated. A lot of consumers though believes that the Letter of Release erases their credit history which is not so. What it does is updates your credit profile to show the account is not owing anymore.
